Project Malleus Terms of Use
Project Malleus provides general medical education content for informational purposes only. It is not a substitute for professional clinical judgement, medical advice, diagnosis, or treatment. If you or someone else has a medical emergency, call your local emergency number immediately e.g. in Australia, call 000.
1. Terms of Use Agreement
- This Terms of Use Agreement ('Agreement') is entered into between you (the user of the Project Malleus Anki deck and any associated materials or platforms, collectively the 'Site') and Project Malleus (the 'Organisation'). Access to and use of the Site is subject to the terms and conditions set forth herein. By accessing, downloading, or otherwise using the Site, you agree to be bound by these terms and conditions.
- This Agreement contains disclaimers and other provisions that limit the Organisation's liability to you. Please read these terms fully and carefully. If you do not agree to each term and condition, do not access or use the Site.
2. Disclaimer Regarding Medical Advice
- Project Malleus provides the Site, including all Anki decks, flashcard content, summaries, references, and linked materials (collectively, 'Content'), for educational and informational purposes only. The Organisation does not provide medical advice.
- Accessing or using the Site does not create a physician-patient relationship between you and the Organisation or any of its contributors. Nothing contained in the Site is intended to establish such a relationship, replace the judgement of a trained clinician, or serve as a substitute for professional medical advice, diagnosis, or treatment.
- You agree that you shall not make any medical or health-related decision based in whole or in part on Content found in the Site. You should consult a licensed physician or appropriately credentialled health care worker in your community in all matters relating to your health and clinical practice.
3. Disclaimer Regarding Site Content
- Content may be changed without notice and is not guaranteed to be complete, correct, timely, current, or up to date. Similar to any printed educational material, Content may become out of date. The Organisation undertakes no obligation to update any Content and reserves the right to make alterations or deletions at any time without notice.
- Opinions expressed in the Site are not necessarily those of the Organisation or its contributors. Any views expressed have been considered in the context of certain conditions and assumptions that cannot necessarily be applied to an individual case or clinical circumstance. Content must not be used or relied upon for any purpose other than personal education, including in connection with any legal, regulatory, or clinical proceeding.
- From time to time, the Site may contain health- or medically-related information that is explicit in nature. If you find such content offensive, you may not wish to use the Site.
4. Accuracy and Currency
- Content is written to reflect the state of medical knowledge and clinical guidelines at the time of authorship. Clinical practice guidelines, drug dosing recommendations, and standard of care are subject to change. Users are responsible for verifying the currency and applicability of any Content against current authoritative sources, including but not limited to the Australian Medicines Handbook (AMH), Therapeutic Guidelines (eTG), and relevant college or specialist society guidelines.
- The Organisation disclaims any liability arising from reliance on Content that has become out of date following changes to clinical guidelines or evidence.
5. Jurisdictional Scope
- Content is written primarily for use in an Australian and New Zealand clinical context, including with reference to local guidelines, formularies, drug names, and healthcare systems. Content may not reflect the standard of care, approved indications, available medications, or regulatory requirements applicable in other jurisdictions.
- Users practising outside Australia and New Zealand are responsible for ensuring that any Content they apply is appropriate and lawful in their jurisdiction.
6. Intellectual Property
- All Content on the Site (excluding ’Third-Party Links and Resources’ - see section 8.0 below), including but not limited to flashcard text, images, summaries, and structural organisation (i.e. tagging system), is the intellectual property of Project Malleus, but can be licensed and modified under CC-BY-SA-4.0.
- Users are granted a personal, non-exclusive, non-transferable licence to access and use the Content for their own private, non-commercial educational purposes only. This licence does not permit resale of the Content in any form without the prior written consent of the Organisation.
- Any modification made to Project Malleus cards and subsequent distribution privately via non-commercial means (outside of AnkiHub or Project Malleus coordinated synchronisation channels) is discouraged, however if performed the user must relinquish the use of the ‘Project Malleus’ title across all cards in all advertising of the modified deck and included content.
- Where Content incorporates or references material from third-party sources, such material remains the intellectual property of the respective rights holders and is used for educational purposes only.
7. Feedback and Error Reporting
- The Organisation welcomes feedback and reports of errors, inaccuracies, or outdated Content. Users who identify such issues are encouraged to notify the Organisation so that corrections can be made.
- The Organisation disclaims liability for any harm arising from erroneous Content in the period between an error being identified and its correction. Submission of feedback does not create any obligation on the part of the Organisation to act on that feedback within any particular timeframe.
8. Disclaimer Regarding Third-Party Links and Resources
- The Site may contain links to or citations of third-party websites and resources, including clinical guidelines, reference texts, and educational materials. These are provided for reference purposes only and do not constitute a guarantee, recommendation, or endorsement by the Organisation of those sources or their content.
- If you access a linked website, you do so at your own risk. Your use of other websites is subject to the terms of use of those sites. The Organisation is not responsible for the content, accuracy, or currency of any linked or third-party resource.
9. Guidelines for Posting and User Contributions
- The Site may be open to user contributions in certain contexts. You should consider carefully what you post and must not submit any information or ideas that you wish to keep private. By uploading or otherwise making available any content to the Organisation, you grant the Organisation the unlimited, perpetual right to distribute, display, publish, reproduce, reuse, and copy that content.
- You are responsible for the content you submit. You may not impersonate any other person. You may not post content that is defamatory, fraudulent, obscene, threatening, invasive of another person's privacy, or otherwise unlawful. You may not post content that infringes the intellectual property rights of any person or entity, or that contains any virus or code designed to disrupt, damage, or limit the functioning of any software or hardware.
- The Organisation reserves the right to remove any content that, in its sole judgement, does not comply with this Agreement or is otherwise objectionable, and to modify, adapt, or edit any submitted content.
10. Disclaimer of All Warranties
- Content made available at the Site is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. Under no circumstances, as a result of your use of the Site, will the Organisation be liable to you or to any other person for any direct, indirect, incidental, consequential, special, exemplary, or other damages under any legal theory, including without limitation tort, contract, strict liability, or otherwise, even if advised of the possibility of such damages.
11. Age Restriction
- The Site is intended for persons eighteen (18) years of age or older. Persons under the age of eighteen should not access, use, or browse the Site.
12. Indemnification
- You agree to indemnify and hold the Organisation harmless from any claim or demand, including legal fees, made by any third party as a result of:
- any content posted or made available by you on the Site;
- any violation of law that occurs through your use of the Site; and/or
- any use you make of the Site and the Content contained therein.
13. Modification
- The Organisation may modify the terms and conditions of this Agreement in whole or in part at any time for any reason without prior notice. Such modified terms shall supersede these terms and conditions and shall become binding when published on the Site.
14. Entire Agreement
- You accept that this Agreement represents the entire understanding between you and Project Malleus concerning use of the Site.
